Terms of Use

These terms are an agreement between you and Spark & Ink LLC, a Texas limited liability company (“Spark & Ink,” “we,” “us”), and apply when you use Wits: Daily Thinking Games (the “app”) and this website. By using Wits, you agree to these terms. If you do not agree, please do not use Wits.

Using Wits

You must be at least 13 years old to use Wits. If you are under the age of majority where you live, you may use Wits only with the permission of a parent or guardian. You are responsible for keeping your account secure and for activity on your account.

Please use Wits fairly. Do not misuse the app, interfere with it, try to access it in unauthorized ways, copy or resell its content, or use it to break the law.

Wits Plus subscriptions

• Wits is free to start. Some features require a paid subscription called Wits Plus.
• Wits Plus is purchased through the Apple App Store or Google Play and is billed to your app store account.
• Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before the period ends.
• You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app or your Wits account does not cancel a subscription.
• If a free trial is offered, it converts to a paid subscription when the trial ends unless you cancel before then.
• Refunds are handled by Apple or Google under their policies.
• We may change prices or features of Wits Plus. Price changes will be communicated as required by the app store and will apply from your next billing period.

Our content

Wits, including its games, puzzles, text, graphics, and logos, is owned by Spark & Ink or its licensors and is protected by law. We give you a personal, non-transferable, revocable license to use the app for your own non-commercial entertainment.

Your content

If you submit answers or other content in the games, you keep any rights you have in it, and you give us permission to store and process it to operate and improve Wits.

No guarantees

Wits is provided for entertainment and practice. Wits is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not promise that Wits will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Spark & Ink will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising from your use of Wits. Our total liability for any claim relating to Wits is limited to the amount you paid us for Wits Plus in the 12 months before the claim.

Ending use

You can stop using Wits at any time and delete your account in the app. We may suspend or end access if you break these terms or if we stop offering Wits.

Our Privacy Policy explains how we handle your information.

Apple and Google

These terms are between you and Spark & Ink, not Apple or Google. Apple and Google are not responsible for Wits or its content, but their app store terms also apply to your download and purchases.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Texas, unless applicable law requires otherwise.

Changes

We may update these terms. If we make significant changes, we will update the effective date and let you know in the app or by email when appropriate. Continuing to use Wits after a change means you accept the updated terms.
